Types of Guardianship's in Nevada

Guardianship is a legal arrangement where a person or entity is appointed to care for and make decisions for another person, known as a protected person. In Nevada, there are several types of guardianship's designed to meet different needs. Here's a simple overview:

There are two main categories of guardianship's:

Guardianship of a Minor
This type of guardianship is for children under 18. A guardian may be appointed to make decisions about the child’s care, education, health, and living arrangements. This is often used when the parents cannot care for the child due to illness, absence, or other reasons.

Guardianship of an Adult
This applies to adults who are unable to manage their personal or financial affairs due to age, illness, or disability. The guardian helps with decisions about healthcare, daily living, and finances.

Within either an adult or minor guardianship you can request:

Guardianship of the Person
This type focuses on caring for the protected person's personal needs, such as their health, safety, and daily life decisions. It does not include managing the protected person's financial matters.

And/or

Guardianship of the Estate
A guardian of the estate manages the protected person’s financial assets, such as property, income, and expenses. This guardian ensures bills are paid and finances are handled responsibly.

Guardianship's can be sought for an on-going basis, or for an emergency:

General Guardianship
In this case, the guardian oversees both the person and/or the estate of the protected person. They handle personal care and financial matters simultaneously until by order of the court the guardianship is terminated.

Temporary Guardianship
This is a short-term arrangement for urgent situations. A temporary guardian is appointed quickly to address immediate needs, such as emergency medical care. There must be a true, and immediate emergency.

Each type of guardianship has specific requirements and responsibilities. Nevada courts aim to ensure the protected person’s best interests are prioritized while balancing their independence.
